TRAITEMENT DES Renseignements personnels – Définitions

Est un renseignement personnel, tout renseignement qui concerne une personne physique et qui permet, soit pris seul ou en combinaison avec d’autres renseignements disponibles, de l’identifier.

La Société est une société par actions canadienne dont le principal établissement est situé au Québec. La Loi sur la protection des renseignements personnels dans le secteur privé (RLRQ c P-39.1) s’applique en toutes circonstances, sauf dans la mesure où le traitement des données en question est assujetti au RGPD, c’est-à-dire le Règlement général sur la protection des données de l’Union européenne (2016/679 du 27 avril 2016), auquel cas, les articles de la section 4 trouveront application.

  • Portée de la politique et responsabilité de la Société

La présente politique de confidentialité ne s’applique qu’au Site. La Société est responsable des renseignements personnels dont elle a la gestion en lien avec le Site, y compris les renseignements personnels communiqués à des tiers aux fins de traitement et à des fins administratives. Nous sommes notamment susceptibles de partager des renseignements personnels avec des mandataires et partenaires de confiance qui agissent à titre de responsables du traitement des données pour notre compte, notamment pour l’exécution de commandes, le traitement de paiements, l’envoi de courrier par la poste et de courriels, la prestation du service à la clientèle et des services en matière de marketing. Nous ne vendrons en aucun cas vos données personnelles.

La Société peut aussi faire appel à des consultants informatiques tiers afin d’assurer le service et la maintenance du Site ainsi que des produits et services pouvant être offerts par l’entremise du Site. Les renseignements personnels conservés par la Société sont susceptibles d’être stockés dans d’autres juridictions offrant une protection équivalente à celle prévue par la loi applicable au traitement des renseignements personnels.

  • Accès

Sous réserve des lois pertinentes, sur réception d’une demande écrite d’un particulier en ce sens, la Société indique au particulier si elle possède des renseignements personnels à son sujet.

Sur réception d’une demande écrite en ce sens, la Société transmet un résumé de l’utilisation qui a été ou qui est faite des renseignements, communique au particulier l’identité des tiers à qui elle peut avoir communiqué des renseignements personnels le concernant et les fins auxquelles ces renseignements sont transmis au tiers.

La Société peut refuser à un particulier l’accès à ses renseignements conformément aux lois pertinentes, auquel cas elle motive son refus, sauf si la loi le lui interdit.

  • Plaintes

Un particulier sur qui la Société possède des renseignements personnels peut se plaindre du non-respect de la présente politique.

La Société a mis en place une procédure relative à la réception et au traitement des plaintes concernant la présente politique et ses pratiques de traitement des renseignements personnels.

Si un particulier n’est pas satisfait de la réponse de la Société à une plainte ou des politiques et pratiques de la Société en matière de traitement des renseignements personnels, il peut déposer une plainte auprès de la Commission d’accès à l’information du Québec sur le site Web du Commissaire au www.cai.gouv.qc.ca.

DROITS DES PERSONNES CONCERNÉES EN VERTU DU RGPD

  • Application et Interprétation

Les articles de la présente section 4 ne s’appliquent que dans la mesure où le traitement des données en question est assujetti au RGPD. Dans la présente section, chaque expression ou terme employé qui est défini à l’article 4 du RGPD a le sens qui lui est attribué par celui-ci. La Société est le responsable du traitement.
